Judgment
Anand Pathak, J
1 . This petition under Section 482 of Cr.P.C. has been filed by the petitioner for deletion of condition No.7 as imposed in order dated 22.02.2021 passed in MCRC No.9296/2021 while granting regular bail.
It is the submission of learned counsel for the petitioner that petitioner has been granted bail vide order dated 22.02.2021 passed in MCRC No.9296/2021 with the direction that "petitioner shall mark his presence before the concerned Police Station once in a fortnight between 10 am to 2 pm till conclusion of trial". Since year 2021, he is abiding the said condition regularly.
Therefore, he seeks deletion/appropriate modification in the condition.
3 . Learned counsel for the respondent/State opposed the prayer and prayed for dismissal.
4 . Heard the counsel for the parties and perused the record appended thereto.
Petitioner appeared regularly before concerned Police Station and did not break the condition.
6 . Considering the above submissions and looking to the fact that petitioner is complying the order so far for last three years, therefore, said condition is hereby deleted.
Accordingly, petition stands disposed of in above terms.
8 . Rest of the conditions of order dated 22.02.2021 passed in MCRC No.9296/2021 shall remain intact.
9 . This order shall be read in conjunction with order dated 22.02.2021 passed in MCRC No.9296/2021.
Copy of this order be sent to concerned Station House Officer, for compliance.
Copy of this order be kept in file of the MCRC No.9296/2021.
