This application under Section 482 of Cr.P.C has been filed for modification of order dated 07/09/2021 passed in M.Cr.C. No.41788/2021 in which crime number has been mentioned as "343/2020" in place of "343/2021".
It is submitted by counsel for the applicant that a mistake in the order has crept in on account of the mistake in the bail application. In the bail application itself, the crime number was mentioned as "343/2020" whereas it is clear from the impugned order dated 05.08.2021 that the correct crime number was "343/2021". It is submitted that on account of incorrect crime number, the applicant could not appear before the Investigating Officer and accordingly, crime number in the order dated 07/09/2021 may be corrected and applicant may be granted some other date for his appearance before the Investigating Officer.
Heard the learned counsel for applicant.
According to the applicant, the correct crime number is "343/2021". Even in the impugned order dated 05.08.2021, the crime number has been mentioned as "343/2021" but it appears that on account of mistake in the bail application, the same mistake has crept in the order dated 07.09.2021 passed in M.Cr.C. No.41788/2021. Accordingly, this application is allowed. It is directed that the crime number "343/2020" mentioned in the order dated 07.09.2021 passed in M.Cr.C. No.41788/2021 be read as crime No."343/2021". The applicant is directed to appear before the Investigating Officer on or before 23rd of September, 2021.
This order shall be treated as part of order dated 07.09.2021 passed in M.Cr.C. No.41788/2021.
