The applicants have filed these bail applications under Section 439 CrPC in FIR No. 469/2019 registered at Police Station Roopwas, Bharatpur for the offences under Sections 363,376-D IPC.

Heard learned counsel for both the sides and perused the material made available on record.

Learned counsel for the applicants submit that the applicants are quite innocent and they have been falsely implicated in the case. They are not required any more for investigation. Co- accused has already been enlarged on bail by co-ordinate bench. The applicants are behind the bars for more than 5 months. There is inordinate delay of five months in lodging of FIR. Conclusion of trial will take considerable time. The bail applications may be allowed.

Learned Public Prosecutor has opposed the bail applications.

Keeping in view all the facts and circumstances of the case, particularly having regard to the fact that the similarly situated co- accused has already been enlarged on bail by the co-ordinate bench, this court finds it a fit case for bail.

Consequently, without expressing any opinion on merits, the bail applications are allowed and it is directed that the accused applicants Gaurishankar S/o Sh. Lochan Singh and Atar Singh S/o Bhagwan Singh be released on bail provided each of them furnish personal bond in the sum of Rs. 1,00,000/- (Rs. One lakh) together with two sureties of the sum of Rs. 50,000/-(Rs. Fifty Thousand) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when they are called upon to do so.
