The hearing of the case was held through video conferencing on account of restricted functioning of the Courts.
This is the third petition for grant of bail pending trial in a criminal case arising from FIR No.297, dated 05.09.2019, registered under Section 22 of the
NDPS Act, 1985, at Police Station Division No.5, Ludhiana.
The first petition was dismissed on 01.10.2020 with the following order:-
The petitioner prays for grant of bail pending trial in a criminal case arising from FIR No.297, dated 5.9.2019, registered under Section 22 of the
NDPS Act, at Police Station Division No.5, District Ludhiana.
As per the case of the prosecution, the petitioner was allegedly apprehended with 2200 intoxicated tablets brand- Clovidol containing Tramadol
Hydrochloride salt. The alleged recovery falls in the 'commercial category'.
The Forensic Science Laboratory has also reported 1 of 2 presence of salt Tramadal Hydrochloride. In view of the provisions of Section 37 of the
Narcotic Drugs and Psychotropic Substances, 1985, no ground to grant the concession of bail to the petitioner is made out.
Hence, dismissed. However, learned Trial Court is requested to make sincere efforts to conclude the trial of the case as expeditiously as possible,
after the normal functioning of the Court resume.
The second petition was dismissed on 23.12.2020.
The learned counsel representing the petitioner made sincere attempts, however, failed to draw the attention of the Court to any change in
circumstances or any fresh ground for grant of bail.
Hence, dismissed.
All the pending miscellaneous applications, if any, are also disposed of.
