Kailash Gambhir, J.—By way of this application filed u/s 439 Cr.P.C. the petitioner seeks grant of regular bail. Counsel appearing for the petitioner submits that the accused is a young boy of 24 years of age and is not a previous convict. Counsel further submits that without prejudice to the rights of the petitioner he has already deposited a sum of Rs.1,20,000 by way of demand draft dated 27th June, 2008, which is lying in the possession of the concerned I.O. Counsel further stated that the petitioner volunteers to deposit the remaining amount of Rs.1,02,000 within a period of one month with the concerned I.O.

I have heard learned counsel for the petitioner and Mr.Pawan Sharma, APP for the State.

After having taken into consideration the aforesaid submissions made by the respective counsel I am inclined to grant bail to the petitioner, subject to his furnishing personal bond in the sum of Rs.20,000 with one surety in the like amount to the satisfaction of the Trial Court. The petitioner has volunteered to deposit the remaining amount of Rs.1,02,000 within a period of one month with the concerned I.O. Let the same be deposited within a period pf one month. On the failure of the said deposit the present bail granted by this Court shall stand cancelled. On the deposit of the said amount of Rs.1,02,000 by the petitioner the same amount alongwith the earlier amount of Rs.1,20,000 lying deposited with the IO shall be delivered to the complainant. It is made clear that the said payment being made by the petitioner shall be without prejudice to his rights and contentions.

With the above direction the present application is disposed of.
