Judgment
This application has been filed to bring on record the settlement entered into by and between the plaintiff and the defendant on 12th August 2026 and for passing a decree as per the settlement which has been annexed and forms part of this application.
The plaintiff’s authorised signatory Nitin Chowdhury stood as witness and identified not only the application, but also the contents of the Terms of Settlement and his signature appearing thereon.
The defendant’s director Varinder Kumar Sharma has also stood as witness and has acknowledged the terms of the aforesaid settlement and his signature appearing on the said settlement executed on 12th August 2026.
Since the parties have agreed to settle the suit out of their own volition and since the defendant has made over a Demand Draft of Rs.70 lakhs bearing no.515548 drawn on ICICI Bank unto and in favour of the plaintiff in full and final settlement of all the claims of the respective parties in this suit including the suit filed by the defendant before the Commercial Division of the Delhi High Court, as per the above settlement and there being no impediment in recording the settlement and passing a decree in terms of the Terms of Settlement, let the suit being CS-Com/12/2024 be decreed in terms of the Terms of Settlement and the Terms of Settlement be made part of the decree.
The application being IA No.GA-Com/6/2026 stands disposed of.
The department is directed to draw up the decree expeditiously.
All the interlocutory applications, thus, stand disposed of.
The parties shall bear their respective costs.
