Gangaram''s Infotech vs Dena Bank

R. Gururajan, J.—The petitioner in this petition is seeking for a direction to the Bank to furnish the details of S.B. Account No. 6672 of another customer of the Bank.

The petitioner states in the petition that the petitioner is having certain business transactions with one Aravind, son of Gajendra, in the matter of supply of goods on credit basis. The petitioner further states that four cheques were issued by the said Aravind and all those cheques for one reason or the other were dishonoured by the Bank. The petitioner says that the said Aravind has furnished his address as No. 65/1, G.K. Industries, Industrial Estate, Bangalore-59 and he has also furnished his telephone number as 8396536. On inquiry, petitioner noticed that no such person is residing in the aforesaid address. In these circumstances the petitioner sought for details of the account No. 6672 and the Bank in reply in terms of Annexure D refused to give the same. This endorsement is challenged before me.

Heard learned Counsel for the petitioner.

It is an admitted fact that the petitioner is seeking details of another customer of a Bank in the light of the dishonour of cheques. The petitioner cannot as a matter of right demand the details of another account holder from a Bank. The relationship between the customer and a Bank requires some secrecy in the matter. It cannot be granted to a third party as prayed for in the case on hand.

In the circumstances I do not find any grounds to interfere with the endorsement at Annexure D and also do not find any justifiable ground to issue any direction, with regard to the details as prayed for by the petitioner. The petitioner cannot convert the proceedings under Article 226 of the Constitution of India into a roving inquiry with regard to a commercial transaction between the petitioner and one Sri Aravind.
