Judgment
This Civil Revision Petition is filed against the order dated 29.04.2019 in IA No.33 of 2019 in IA No.258 of 2019 in OS No.39 of 2000 on the file of the Senior Civil Judge, Huzurabad.
IA No.33 of 2019 is filed for appointment of an Advocate Commissioner for partition and separate possession of the suit schedule properties, pursuant to the preliminary decree passed in OS No.39 of 2000. That application filed by the plaintiff was allowed and the Advocate Commissioner was appointed, as per the orders dated 29.04.2019.
Now the petitioners/respondents/defendants have carried the matter before this Court, through the present revision petition questioning the said order dated 29.04.2019. But, they remained absent without any representation.
Having regard to the fact that the original suit was filed in the year 2000 for partition, the preliminary decree was passed on 14.12.2006 and final decree proceedings were initiated in the year 2009 wherein in the year 2019 the Advocate Commissioner was appointed for partition and separate possession of the suit schedule properties, this matter was carried in the revision before this Court and the revision petitioners/defendants not showing any interest in prosecuting the matter, I do not find any merit to adjourn the matter. The presence or representation on behalf of the revision petitioners/defendants is felt essential.
In the result, the Civil Revision Petition is dismissed for non-prosecution. However, there shall be no order as to costs. Miscellaneous applications, if any pending in this revision petition shall stand closed.
