Judgment
Kurian Joseph, C.J.—The application was filed before the Tribunal with the following reliefs:
(i) That the impugned Orders Ann P-1 to P-3 may kindly be quashed/set aside & Respondents may be directed to pay all the consequential benefits along with interest.
(ii) That the Respondent may be directed to fix the pay of the applicant according to Rules along with allowances & pay the same to the applicant along with interest, within a stipulated period. iii) That the Respondent may be directed to allow the applicant on the present post as regular clerk or obsorve the applicant in any other Deptt. of the Respondents.
On the abolition of the Tribunal the matter was transferred to this Court and registered as a Writ Petition.
In para No. 9 of the reply filed on behalf of second and third Respondents it is stated as follows:
That the para No. 9 of the O.A. is admitted to the extent of the representation which is pending before additional registrar co-op. societies, Shimla. Rest of the para is wrong, incorrect and not admitted. However, it is submitted in reply that the applicant has efficacious remedy by way of appeal under Rule 22 of The Mandi Urban Co-op. Bank Ltd. Extract of rule attached as annexure R-4.
Being a Co-operative Society it is for the Petitioner to get relief in terms of the provisions of the Co-operative Society Act or in appropriate other proceedings. Writ Petition is not a proper remedy available to her. Therefore, without prejudice to the Petitioner''s taking recourse for appropriate remedies available to her under the relevant statutes, the writ petition is dismissed.
