THE APPELLATE TRIBUNAL :
Heard learned counsel for the appellant at length. During the course of hearing learned counsel for the appellant submits that she may be permitted to not press the appeal with the liberty to raise her plea regarding valuation of the property in a pending SARFAESI proceeding regarding disputed property.
Learned counsel for the respondent submits that auction sale has been concluded and sale is confirmed. Sale Certificate is also issued.
Accordingly, appeal is dismissed as not pressed with the liberty to the appellant to raise the plea regarding valuation of the property in a pending SARFAESI proceeding, if any. It is made clear that this order is passed without entering into the merit of the case. No order as to costs.
File be consigned to record room.
Copy of the order be supplied to the appellant and the respondents and a copy be also forwarded to the concerned DRT.
Copy of the judgement/Final Order be uploaded in the Tribunal’s website.
