Judgment
Sandeep K. Shinde, J
Apprehending the arrest in connection with Crime No. 681 of 2020 for the offences punishable under Sections 395, 341 of IPC, Applicant seeks
pre-arrest bail.
Mr. Agarkar, learned APP, seeks time to verify the role of the Applicant in the subject crime.
Mr. Bohade, learned Counsel for Applicant submits that investigation in the case is over and the charge-sheet has been filed. Thus submitted that
Applicants' custodial interrogation is not required. Mr. Bohade has relied on the order passed by this Court releasing one of the accused on bail. He
submits that the Applicant's name has not been disclosed in the FIR. Submission is that Applicant has been falsely implicated in the case.
It appears that the Applicant successfully kept himself away from the investigation since December, 2020, as could be seen from the order passed
by the learned Sessions Court. Today for the first time, application is taken-up for the consideration. Therefore, time granted to prosecution to
ascertain the complicity of the Applicant in the offence of Highway robbery.
Hearing of the application is adjourned to 16th June, 2021.
