Judgment
Kurian Joseph, C.J.—The writ petition is filed with the following prayers:
(i) That Respondents No. 1 to 5 be directed to take action on the representations made by the Petitioner and register FIR against the Respondents No. 6 to 15 in accordance with law.
(ii) That the Respondents No. 1 to 5 may be directed to ensure that Respondents No. 6 to 15 are not created any hindrance over the path leading to the village and houses of the Petitioner and other similarly situated persons as well as they may not pollute the drinking water sources and uproot the water pipelines laid by the Petitioner and other similarly situated persons.
In para 3 of the reply, it is stated as follows:
That the contents of para they are admitted. It is submitted that Petitioner has filed complaint on 17.5.2010 and 23.5.2010 and on receiving the complaints from Petitioner two complaints cases were filed before SDM B/Nagar. It is further submitted that on 17.5.2010 there was a cross complaint by Sh. Govind Singh against the Petitioner and his wife and after investigation a complaint case u/s 107/150 Code of Criminal Procedure has been filed against the Petitioner before SDM Nichar at B/Nagar and all above complaints are still pending before SDM Nichar at B/Nagar.
In view of the reply, as extracted above, it is for the Petitioner to pursue the matter before the forum, where the cases are pending. However, in view of the dispute between the parties, there will be a direction to the Police to see that the law and order is strictly maintained.
The writ petition is disposed of, so also the pending applications, if any.
