Gambhir Singh and Others. vs State and Others

B.S. Verma, J.—Heard learned Counsel for the parties.

By means of this writ petition, the Petitioners have sought writ in the nature of mandamus directing the Respondents to pay regular pay scale to the Petitioners on the post of Assistant Teacher from the date of their initial appointment as granted to the similarly situated persons.

The main contention of learned Counsel for the Petitioners is that C.P. Ed. certificate holders who have been appointed before 1995 they have been given regular pay scale from the initial date of appointment and their seniority also has been counted from the date of initial appointment. He further contended that Petitioners made a representation in the year 2000 and till date no decision has been taken.

The authority to grant regular pay scale is the State Government and Petitioners have not moved representation before said authority.

Having heard learned Counsel for the parties, the writ petition is disposed of finally giving liberty to Petitioners to make a representation before the State Government for redressal of their grievance, which is being raised in the present writ petition. If such representation is made by the Petitioners, the same shall be decided within a period of 8 weeks by a reasoned and speaking order from the date of production of certified copy of this order in accordance with law/Government Order.
