Judgment
Barkat Ali Zaidi, J.—Accused along with his employees who is also named in the first information report is said to have looted 31 litres of Menthol oil from the complainant on the night between 27/28.7.2008 in the jungle of chakpheri when the complainant was returning from the Petrol Pump along with his nephew. They are also said to have tied up by the accused and three of his accomplices. It is mentioned in the first information report dated 16.7.2007 that in all there were four persons, out of which two were unnamed, have not been arrested.

Extra ordinary delay in lodging a first information report is by itself sufficient ground for grant of bail. The Sessions Judge rejected the bail application merely on the ground that there are other numerous criminal cases pending against the accused applicant that is not a situation, which should impede grant of bail in a particular case.
Bail need not, therefore, be refused.
He be released on bail on his furnishing a personal bond of Rs. 15,000/with two sureties in the like amount, to the satisfaction of C.J.M., Moradabad.
Application Allowed.
