The matter is taken up through Virtual hearing.

Heard Surendra Kumar Posti, learned Senior Counsel, assisted by Mr. Ashutosh Posti, learned counsel for the writ applicant and Mr. Pradeep

Joshi, learned Additional Chief Standing Counsel for the State.

The argument of learned counsel for the petitioner is that by constructing a road near the village there imminent threat to the stability of the houses

of the villagers already constructed in the villages Beena Gaon and Jhangor Gaon. They have grievance regarding the alignment of the road. In this

connection, the residents of both the villages have already given a representation along with the annexures to the respondent no. 3, who has not given

any attention to the same.

In that view of the matter, the writ application is disposed of directing the opposite party no. 3 to hold a local inspection with respect to the

proposed road, which is being constructed and after hearing the parties concerned, including the villagers of the aforesaid two villages, take a decision

on the representation within a period of 15 days from today. Learned counsel for the petitioner undertakes that the petitioner shall produce a

downloaded copy of this Order from the High Court website with an endorsement of correctness by Mr. Ashutosh Posti, within 10 days along with

copy of the writ application.

Learned Additional Chief Standing Counsel shall also intimate about this order to the parties concerned.
