Judgment
Ajay Rastogi, J.—One of the contentions advanced by the counsel for Petitioner is that he proceeded on sanctioned leave but after his return from leave was not permitted to join which compelled him to approach this Court by filing instant petition.
Reply to the writ petition has been filed wherein certain averments have been made about period of leave availed by the Petitioner and the period for which he remained willful absent from duty. It has also been averred that inquiry at one stage was initiated against him regarding willful absence from duty as alleged, but no document has been placed on record which could substantiate the fact which the Respondents have referred to in their reply.
Counsel for Respondent is directed to file additional affidavit disclosing present status of the enquiry if any initiated against the Petitioner and so also the relevant documents of which reference has been made to supra, with advance to Petitioner''s counsel, who may also examine and file further counter, if so advised.
List on 19.04.2011, as prayed.
