Judgment
Prafulla C. Pant, J.—Applicant Geje Singh Patwal, who is in jail in connection with FIR No. 80 of 2010, relating to offences punishable u/s 302, 201 of I.P.C., police station Lalkuan, District Nainital, has sought his release on bail.
Heard learned Counsel for the parties.
The applicant is not named in the first information report. It is pleaded that no motive has been shown for commission of crime. Recovery of mobile, chappals of the deceased, and a screw driver are shown from the applicant. Learned Counsel for the applicant argued that no one would take chappals of the deceased from the place of occurrence to his house, so that such recovery as alleged, is made.
Having considered submissions of learned Counsel for the parties, without expressing any opinion as to the final merits of the case, this Court is of the view that the applicant deserves bail.
The bail application is allowed. Let the applicant Gaje Singh Patwal be released on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Nainital.
(Urgency Application No. 328 of 2011 also stands disposed of).
