Heard learned counsel Ms Radha Mishra appointed by the High Court Legal Services Sub Committee at Nagpur to represent the petitioner and learned Additional Public Prosecutor Mrs.N.R.Tripathi for respondents/State. Rule. Rule made returnable forthwith. Heard finally by consent of learned counsel for parties.
By this petitioner, the petitioner is praying that he may be given work as “Nightwatchman” in the prison.
In our opinion, learned counsel for the petitioner could not point out that any prisoner has such a right to claim any status inside the prison. It is always open for jail administration to run administration smoothly. If conduct of the petitioner is proper, it will always be open for the jail authorities to appoint the petitioner as “Nightwatchman” if they choose.
In this view of the matter, since no case is made out, the criminal writ petition is dismissed and disposed of.
Fees payable to learned counsel Ms Radha Mishra appointed by the High Court Legal Services Sub Committee at Nagpur to represent the petitioner are quantified at Rs.2500/-.
