Present is a second round of litigation. In the earlier round, writ petition i.e. WPS No.5190/2017 with a similar issue was disposed off on

04/10/2017. This Court only granted relief to the petitioner by directing the respondents to decide the representation within four weeks. Subsequent to

the disposal of the said writ petition, the representation made by the petitioner has now been rejected vide order dated 12/01/2018. At this juncture, the

petitioner makes limited prayer that the authority concern i.e. respondent No.1 in particular, may reconsider the case of the petitioner and if possible,

the petitioner may be granted opportunity of hearing in person by the Secretary so as to communicate in respect of the genuine reason.

Learned State counsel opposes the prayer and submits that the matter has already stands decided.

Without expressing anything on merits of the case, this Court is of the opinion that the ends of justice would meet if the writ petition is disposed off

with a direction to respondent No.1 to reconsider the representation of the petitioner. Considering the nature of contentions put forth by the petitioner,

particularly on his health side, if possible, the Secretary may hear the petitioner in person and then decide the representation.

With the aforesaid observations, this petition is finally disposed off.
