Learned Counsel for the Complainant has informed the Bench about the settlement agreement dated 23.09.2023 under which the parties have claimed to have settled their disputes finally on the payments as referred to in the settlement being made. The first is Rs.48,17,384/- towards the residential unit which is being refunded and Rs.37,44,254/- towards interest and compensation. Two bank drafts with regard to the same are admitted to have been received by the complainants and photocopies of the said bank drafts have already been placed before the Bench drawn on Kotak Mahindra Bank, Gurgaon. It is not disputed that the said bank drafts have been encashed under the aforesaid settlement.
Learned Counsel for the Complainant urges that the copy of the agreement settlement was given later on and there appears to be an incorrect calculation of interest on the amount paid. If that be so it is open to the complainant to seek such remedy as may be available to the complainant before the appropriate forum if he prefers to question the recital therein, but so far as this consumer complaint is concerned the said settlement agreement dated 23.09.2023 closes the dispute between the parties that has been entered voluntarily.
Consequently this complaint stands disposed of in terms of the settlement dated 23.09.2023 without prejudice to the rights of the complainant to seek his remedy for his grievances if any before the appropriate forum in accordance with law.
