-HEARD. BY the order impugned the Forum below has dismissed complaint of appellant claiming refund of Rs. 1,691 debited by the respondent-Bank in appellant''s account on account of his not maintaining minimum balance amount in his account.

THE appellant had opened salary account with the respondent on 1. 1. 2003. Not only the appellant but his colleagues in the same organization had opened similar accounts. However, as per appellant''s own showing, he and his colleagues had informed the respondent-Bank that on account of refusal of permission by the senior officials, they are not able to credit their salaries regularly with the respondent-Bank. However, the appellant continued with the account. Since the salary was not being credited in the account regularly, he fell short of the minimum balance on many occasions. Bank rules required a minimum balance to be maintained by every customer. The rules further provide for levying charges for not maintaining the requisite minimum balance. Since the appellant failed to maintain minimum balance the respondent-Bank was justified in levying charges for the same. The Forum below was right in holding that no deficiency could be attributed to the respondent-Bank on this count. The complaint of appellant has been rightly dismissed. This appeal also thus fails and is dismissed. No order as to costs. Appeal dismissed.
