S. Nagamuthu, J.—Since common issues are involved in these writ petitions, they were heard together and they are disposed of by means of this common order. The petitioners in W.P. (MD) Nos. 19196 to 19198 of 2013 have challenged the key answers to question Nos. 4, 13, 19, 27, 28 and 88 in booklet series ''B'' in Paper - II in the Tamil Nadu Teacher Eligibility Test - 2013 held on 18.08.2013 and the petitioner in W.P. (MD) No. 19199 of 2013 has challenged the key answers to question Nos. 13 and 122 in booklet series ''D'' in Paper - I in the Tamil Nadu Teacher Eligibility Test - 2013 held on 18.08.2013.

These Writ Petitions have come up today for admission.

It has been held by the Hon''ble Supreme Court in Kanpur University and Others Vs. Samir Gupta and Others, that it should be presumed that the key answers set by the paper setter are correct, unless it is demonstrably wrong. Keeping in mind the above principle, let us now examine the challenges made to the key answers in the present writ petitions.

I have heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondent. I have also gone through the records carefully.

Question No. 4 reads as follows:

The petitioner in W.P. (MD) No. 19199 of 2013 has challenged the key answers to question Nos. 13 and 122 in booklet series ''D'' in Paper - I.

(C) Skill (D) Physical health

According to the Key Answer option ''A'' is right answer. But according to the petitioner option ''D'' is the right answer.

The learned counsel for the petitioner relied on the book titled "Psychology of Learning and Human Development" authored by Prof. K. Nagarajan, wherein in page 90 it is stated that Physical Health of the student also is responsible for the attention of the student. The learned counsel also relied on yet another book titled "Psychology of Learning and Human Development", authored by one Prof. A. Meenakshisundaram, wherein also similar answer has been given.

But the question relates to Psychological factor helpful for learning, but not the attention of the student in classroom situation. Therefore, this challenge is rejected.

The petitioner has nextly challenged question No. 122. Question No. 122 reads as follows:

Non-conventional sources of energies'' one example is

(A) Wind energy (B) Hydro power

(B) Solar energy (D) Bio-mass

The key answer given by the Teachers Recruitment Board is Option "C". According to the petitioner, option "D" is the right answer. It is well known that conventional sources of energy are non-renewable sources of energy, which are being used for a long time. The resources of such conventional energy are depleting. Example: Coal, Oil and natural gas, etc.

Non-conventional sources of energy are inexhaustible. They are indefinite and restorable. Some of the non-conventional energy sources are tidal energy, solar energy, wind energy and bio-mass energy. Even the document "Bio-mass Power and Co-generation Programme", published by the Government of India, Ministry of New and Renewable Energy, which declares that bio-mass is a renewable and widely available carbon-neutral and has the potential to provide significant employment in rural areas. Thus, even according to the Government of India, it is a non-conventional energy source.

Further, the Ministry of New and Renewable Energy, Government of India, has issued a document titled "Wind Power Development in India", wherein, it is stated that wind power is a non-conventional source of energy. Similarly, solar energy has also been declared as a non-conventional renewable energy source by the Ministry of New and Renewable Energy, Government of India.

Thus, even according to the Central Government Document, solar energy, wind energy and by-mass energy are non-conventional energies; whereas hydro-power is a conventional source of energy. Therefore, in my considered view, mark should be awarded to the candidates who have answered options "A", "C" and "D". Accordingly, Teachers Recruitment Board is directed to revalue the answer papers of all the candidates and award marks for those who have answered either Options "A", or "C" or "D", as the correct answer. In the result, these Writ Petitions disposed of accordingly. No costs.

Consequently, connected Miscellaneous Petitions are closed.
