5.

We have heard the ld. AR and the ld. DR. The ld. AR at the very outset submitted that the ld. C IT(A) ought to have condoned the delay as it was the first year being A.Y . 2016-17 when the For m 10 was introduced to be filed for the purpose of claiming benefit of accumulation u/s 11(2) of the Act. It is further argued that the ld. CIT(A) has dismissed the appeal contrary to the Circular dated 2 0.12.2018 issued by the CBDT wherein ld. CIT(E) was authorize d to consider the grounds for condonation of d elay for filing the Form 10 since it be ing first year of introduction of the Form 10 for the said purpose. It is further submitted that the denial of the condonation of de lay in filing Form 10 was challenged by the assessee by filing W.P .(C) No. 4091/2019 in the Hon’ble High Court of Delhi and the said fact was brought to the no tice of ld. CIT(E) who has not considered the said fact and d ismissed the appeal and denied the co ndonation of delay in filing the Form 10 resulting into additio n being confirmed which was made by the Assessing Officer for delayed filing of the Form 10. It is submitted that the Hon’ble High Court has condoned the delay vide order dated 27.04.2026. Hence, it is prayed that the matter be restored to the AO for considering the benefit of accumulation u/s 11(2) of the Act.

6.

The ld. DR in vie w of the order of the Hon’ble High Court of Delhi dated 27.04.2026, copy of the same is placed on record, has left it to the discretion of the court to restore the matter to the AO who shall examine the claim of the assessee for accumulation u/s 11(2) of the Act.

7.

We have consid ered the rival submissions. Since, the delay in filing the Form 10 electronically has been condoned by the Hon’ble High Court, we deem it expedient to restore the matter to the file of the AO for considering the claim of the assessee as per law and to extend the benefit of accumulation, if the claim is found lawful and correct. The impugned order is according ly set aside and appeal of the assessee is allowed for statistical purpose.

8.

In the result, the appeal of the assessee is allowed for statistical purposes.
