Judgment
A.S. Bopanna, J.—The petitioner is before this Court, assailing the endorsements dated 28.03.2014 impugned at Annexure - ''A'' to the petition.
The petitioner who had secured 89 marks in the subject - Drafting, Pleading and Conveyancing was denied the benefit of the same, while the marks-card was issued to her by the first Respondent University. Instead she was awarded 52 marks. In that view, the petitioner had sought for rectification of her marks card to indicate that she has secured 89 marks in the said subject. In response to her request, the communication dated 28.03.2014 addressed to the Principal of the first respondent had been issued.
Though presently the petitioner alone is before this Court, putting forth her grievance with regard to the first respondent having not rectified marks-card, while considering the case as put forth by the learned counsel for the parties, it is noticed that the examination in the said subject would be conducted by the college and the marks assigned in the said subject would be dispatched to the University so as to enable the University to draw up the list relating to the marks awarded and thereafter include the same in the marks-card to be provided to the students.
In that regard, a perusal of the documents produced along with the writ petition regarding which there is no serious dispute between the parties, the list of marks sent by the College to the University is at Annexure - ''C'' to the petition. The serial number assigned and the order in which the names are mentioned is not inconsonance with the list as maintained by the University as at Annexure - ''G'' to the petition. To demonstrate this, if the name of the petitioner is noticed, it is entered at Sl. No. 24 at Annexure - ''C'' while it is shown as Sy. No. 12 in Annexure - ''G'', in the list drawn by the University. The marks are assigned to the person at Sl. No. 12 in the list drawn by the college, i.e., 52 marks has been assigned to the petitioner who is shown at Sl. No. 12 by the University. The marks as obtained by the petitioner has been assigned to the person who is indicated at Sl. No. 24 in the list drawn by the University since the name of the petitioner is shown in Sl. No. 24 in the list drawn by the college. The said anomaly has led to the error which infact has the genesis to the list as sent by the college, which is not prepared by the college in accordance with the requirement of the University.
Having noticed these aspects of the matter, not only the grievance of the petitioner needs consideration but the grievance of all other students who had appeared for the said Examination through the Respondent College would also have to be addressed and the corrected marks-card is to be issued to the students if they approach the University. To enable the same, the process shall be redone by the second Respondent College by indicating the serial number of the students in the same order as has been indicated in Annexure - ''G'' to this petition and the marks as obtained by the students shall be entered in the said list as per the records of the second respondent college. On receipt of such list by the first respondent, the first respondent shall take note of the same and re-issue the marks-card indicating the marks as obtained in the said subject correctly as per the list to be sent by the college, if such students approach the University seeking correction.
To complete the process in a time frame, the college shall now send the corrected list in the same order as at Annexure - ''G'' with the marks entered correctly to the University within two weeks from the date on which the copy of this order is furnished to the second respondent. The first respondent University shall issue the corrected marks-card to the petitioner so also the other effected students who may approach them. The petitioner shall be issued the corrected marks-card within three weeks from the date on which the particulars are received from the second respondent college.
In terms of the above, the petition stands disposed of.
