By this application, interim bail is sought by the Applicant for five days from 27th December 2025 till 31st December 2025 to attend wedding and reception ceremony of his only son at Bhopal. The invitation card is annexed as Exhibit ‘A’ to present application.
The learned Additional Public Prosecutor for the Respondent No.1-State opposed the application. Alternatively, she submits that the period for which the interim bail is excessive. She further submitted that if at all interim bail is granted, then applicant should bear all the expenses incuding transportion etc. of escorts of three police officers, who would accompany him.
I have heard learned counsel appearing for the Applicant and the learned Additional Public Prosecutor.
Admittedly, the Applicant did not attend the trial and, therefore, warrant was issued. However, now he has been apprehended and is in Central Prison at Satara.
From the averments made in the application and for the reasons stated therein, it appears that the Applicant should be permitted to attend wedding ceremony of his only son. However, request made for five days is excessive. Therefore, the permission is granted to attend the wedding ceremony and reception on 27th December 2025 and 28th December 2025 only. Since the Applicant is in jail in Satara and venue is at Bhopal, it would require some time to travel. Therefore, keeping in mind all the factors, the Applicant is permitted to attend wedding ceremony on the following terms and conditions:
The Applicant will be escorted by three police officers of the State of Maharashtra. All the expenses of travel and escort including their stay, lodging and boarding etc. will be borne by the Applicant.
The Applicant to deposit Rs.2,00,000/- as an advance towards the escort expenses, which will be adjusted agaisnt actuals, when he returns back to Central Prison at Satara. The said deposit to be made with the Registry of this Court. If the actual expenses are found to be more than Rs.2,00,000/-, the same will be adjusted against deposit of Rs.3,00,000/-.
The permission is granted to travel from 26th December 2025 to 28th December 2025. The Applicant to leave wedding and reception venue on 28th December 2025 at 11:30 p.m., so that he can reach Central Prison at Satara on 29th December 2025.
The police officers escorting the Applicant would be in civil uniform.
The concerned police station of State of Madhya Pradesh at Bhopal are requested to cooperate with Maharashtra Police authorities, who will be escorting applicant in all respects, as and when need arises.
If the vehicle to be escorted with the Applicant is police vehicle, then the same will be kept at a distance of 500 meters from the venue.
The Applicant should ensure that he does not make any attempt to escape, nor any attempt during these two days to influence any witness, although the investigation is over.
The Applicant to deposit sum of Rs.3,00,000/- in this Court and the said amount will be refunded when the applicant returns on 29th December 2025 and report to Central Prison at Satara.
On receipt of Rs.5,00,000/- (Rs.3,00,000/- + Rs.2,00,000/-) all the Authorities to act upon authenticated copy of this order including the trial Court and in-charge Court. This is done to avoid any further delay, because applicant has to attend the wedding tomorrow and has to leave Satara today.
The learned APP to give details of actual expenses of escorting on the next date and the same will be adjusted from amount of Rs.2,00,000/-.
The Superintendent, Satara Prison and Superintendent of Police, Satara are hereby directed to ensure the effective implementation of this order.
An authenticated copy of this order to be furnished to in-charge Court by the learned Advocate for the Applicant and the said Court will act upon the same.
The Applicant is permitted to travel as stated above.
List the application on 5th January 2026 to apprise the Court about the compliance of this order by the Applicant.
