Judgment
Ratnaker Bhengra, J
When the matter is called out, both the learned counsels have appeared.
Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. He further submits that there are many sections but the main section is section 386 IPC. He further submits that however no case is made out under section 386 IPC. He further submits that firstly case was lodged by the informant's side and in retaliation case was lodged from the petitioner side. He further submits that the petitioners are the members of the Madarsa Khairul Islam and they asked for rent. The petitioner no.1 has also lodged a case against the informant. He further submits that informant's party have got no injury rather petitioner no.1 got some injury. He further pointed out paragraph no.7 of the case diary wherein Farid Khan has testified the petitioners as members of the Madarsa committee.
Learned counsel for the State opposed the prayer for anticipatory bail and submits that petitioners are named in the FIR.
Regard being had to the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioners, named above. Accordingly, the petitioners are directed to surrender before the learned Court below within a period of two weeks from today and on their surrender or arrest, they shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand Only)each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Palamau at Daltonganj, in connection with Hussainabad P.S. Case No. 304 of 2022, subject to the condition that the petitioners will furnish their mobile numbers and photocopy of the Aadhar Cards with an undertaking that they will not change their numbers during pendency of the case. Further the petitioners shall remain present on each and every date of trial unless dispensed with by the learned Court below and subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
This application stands allowed.
