Judgment
P.K. Jain, J.—List has been revised. None appears for the revisionist. Heard A. G. A. and perused the record. Revisionist Faqirey Lal was convicted u/s 7/16 of the Prevention of Food Adulteration Act for selling adulterated rapeseed oil. He was sentenced to undergo rigorous imprisonment for six months and to pay a fine of Rs. 1,000 and in default of payment of fine to undergo further imprisonment for three months. Criminal Appeal No. 130 of 1983 preferred by him was dismissed by the Ist Additional Sessions Judge, Farrukhabad on 18.8.1983.
By this revision, the revisionist challenges the finding of the courts below and conviction for the aforesaid offence on the ground that there was no sanction obtained, on compliance of provision of Section 13(2) of P. F. A. Act made and the sample of rapeseed oil was taken, whereas standard for local rapeseed oil has been applied.
The courts below have dealt with all these grounds in detail and cogent reason has been given in support of the finding arrived at by the courts below. No interference is called for. The revision is dismissed. The revisionist shall surrender forthwith to serve out the sentence awarded to him. Stay order dated 26.8.1983 is vacated.
