The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of order dated 29.09.2005 whereby they were asked to appear in Computer Test.

A Division Bench while issuing notice of motion on 20.10.2005 observed that petitioners may participate in test scheduled to be held on 24/25.10.2005, however, result thereof shall not be given effect till further orders. Order dated 20.10.2005 reads as:

“Notice of motion for 27.02.2006.

The petitioners may participate in the test scheduled to be held on 24/25.10.2005 and the result thereof shall not be given effect thereto till further orders.

Copy of the order be supplied dasti on payment.”

Learned State counsel submits that most of the petitioners have already retired on attaining the age of superannuation. The respondent has not given effect to test which was under challenge, thus, petition has rendered infructuous.

In the wake of statement of learned State counsel, the petition stands disposed of.
