Judgment
V. Chitambaresh, J.—The period of the housing loan expires only in the year 2018. The petitioner is not liable to pay any over due amount as now. The total liability as on today comes to about Rs. 3,34,108/-. The petitioner shall continue to pay the Earnest Money Interest as agreed. The petitioner however seeks easy installments to pay the loan to availed of by way of cash credit facility. The period of the loan has expired on 28.9.2012 and the same has not been renewed. The total liability in the loan towards cash credit facility comes to about Rs. 12,21,060/-. I permit the petitioner to repay the loan availed of as cash credit facility in six equal monthly installments starting from 1.8.2013.
The coercive proceedings against the petitioner pursuant to Ext. P5 order shall be put on hold if the petitioner complies with the conditions in time. The coercive proceedings can surge ahead in case the petitioner commits default in the payment of any one of the installments.
The Writ Petition is disposed of.
