This application has been filed for placing on record Annexure P-2.

Petitioner - Fakruddin has applied for grant of regular bail in FIR No. 53 dated 27.3.2010 under Sections 147, 148, 149, 332, 353, 186, 307, 427 IPC, registered at Police Station Bawal, District Rewari.

As per allegation of the prosecution, on 27.3.2010 police party was on patrolling duty in the area of village Nangli Parsapur. Ram Kumar EASI No. 115 has stated that he was on duty on PCR No. 13 as Incharge on night patrolling along with Head Constable Sandeep and other police party. At 3.00 A.M. A V.T. was received from Control Room that a Tata 407 vehicle, in which 10-12 young boys are sitting have committed an incident with a boy near Baghrana and said Tata 407 be rounded up. On this information, they tried to catch Tata 407. 10-15 persons were there. On seeing the police party they took a turn and ran the vehicle towards Nehchana. On the basis of suspicion, the police party followed them. It is further alleged that the driver of the said vehicle tried to kill the police party by reversing the vehicle hitting the PCR twice and stones were pelted on the police party, in which 4 police officials were injured.

Similarly situated accused Birju has been allowed the concession of bail by this Court vide order dated 5.1.2011 passed in Crl. M. No. M-34726 of 2010, after he has undergone incarnation for about 5 months. Salim, the other co-accused is stated to have been granted bail by the Additional Sessions Judge.

The Petitioner is stated to be in custody since 25.7.2010. So, on the grounds of parity, the bail application of the Petitioner stands allowed. Bail to the satisfaction of the trial Court.
