Judgment
This is repeat bail application under Section 439 of Cr.P.C. for grant of bail to the applicant, who has been arrested on 14.07.2019 in connection with
Crime No.225/2019 registered at Police Station Gandhi Nagar, Bhopal, District Bhopal, for the offences punishable under Sections 302, 201 and 34 of
IPC.
Counsel appearing for the applicant submitted that his earlier bail application was rejected on the ground that there are criminal antecedents against
the applicant. It is further submitted by him that he has been acquitted in all the cases except two. One case is under Section 302 of IPC and other
case is under Section 294, 323, 506, 34 of IPC. In these circumstances, he made a prayer for grant of bail to the applicant as other co-accused
persons have already been released on bail. Other co-accused persons have been enlarged on bail as there was no criminal antecedents against them.
Against applicant, there are as many as 11 criminal antecedents. In some cases he has been acquitted. Judgment of 3 cases in which he is acquitted is
filed by applicant and judgment of other cases is not filed.
Looking to the criminal antecedents of applicant, repeat bail application is dismissed.
Applicant is at liberty to file fresh bail application if he had been acquitted in all criminal cases except one in which applicant is in jail.
