Judgment
Heard Mr. U. K. Barman, learned counsel for the petitioners. Also heard Mr. D. Das, learned Addl. Public Prosecutor for the State/respondent.
Case dairy, as called for, is received.
Issue notice to the informant asking as to why she shall not be prosecuted in view of her affidavit sworn on 30.10.2021 stating that false FIR was filed
against the petitioners.
Considering the facts and circumstances of the case, in the interim, it is provided that the petitioners, namely, 1. Faijuddin Ali, 2. Abdul Ali, 3. Mafidul
Ali @ Bobidul Ali, in connection with Sipajhar P.S. Case No. 620/2021 u/s 498(A)/376/325/34 of the IPC, shall be released on interim pre-arrest bail
on furnishing bail bond of Rs.20,000/- each with one surety of like amount to the satisfaction of the arresting authority, subject, of course, to the
following conditions:
(i) That the petitioners shall appear before the Investigating Officer within 7 days,
failing which on and from the 8th day, this interim-pre arrest bail order shall have no force; and
(ii) That the petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so
as to dissuade him from disclosing such facts to the Court or to any police officer.
Return the case diary for resubmission on 17.03.2022.
Steps be taken within 5 (five) days.
