Judgment
HEARD Mr. S.K. Mohanty, the learned Counsel for the appellant. None present for the complainant. Perused the impugned order, Complainant approached the District Forum with an allegation that one Bata Krushna Salal, O.P. No. 2 in the original case then working as Revenue Inspector under the Collectorate, Mayurbhanj was possessing a plot towards the western side residential plot of the complainant and he blocked the drain by constructing Pucca wall, as a result of which drain water could not be discharged and was accumulating around the Kuchha residence of the complainant thereby the mud constructed wall was in danger of being collapsed at any time.
IT is case of the complainant that although he brought this fact to the notice of the Executive Officer, Baripada Municipality, no steps have been taken. Having gone through the impugned order, we are of the view that such a case would not be maintainable in the Consumer Court. Accordingly allow this appeal and direct the complainant to move the appropriate authority either under the Civil Court or any other Forum for redressal of his grievance as the case may be. Appeal allowed.
