After making submissions for sometime counsel for petitioner on instructions submits that he may not like to address the Court on merits, however, submits that since under the interim order of the Court he has paid the concessional fee at least this protection may be provided that respondent may not charge from the petitioner the arrears towards tuition fee during the period of interim protection granted to him. Counsel for respondent submits that it was only an interim arrangement made by the Court but that may not preclude them from charging arrears for the earlier period but he can still advise to his client.

Since the petitioners are ex-servicemen persons who at one stage served the Indian Air Force and their wards are presently the students in various Air Force Schools, under these circumstances, this Court considers it appropriate to observe that the respondent will be at liberty to charge their normal fee in future but may not charge the arrears for the period during which interim protection remain in favour of the petitioners. With these directions/observations, the petitions stand disposed of.
