Dr. N. Mozika, learned DSGI assisted by Ms. A. Pradhan, learned counsel for the respondents Nos. 1 to 5, today has produced a communication dated 11.06.2024, addressed to the Legal Officer, Assam Rifles. The said letter acknowledges the fact that the petitioner had submitted a scanned copy of the Life certificate to the concerned Branch, but that other formalities were still required, as noted in the said letter at Paragraph-2. He however, submits that perhaps the matter can be closed by allowing a certain timeframe for the formalities to be completed.

Mr. S. Pandey, learned counsel for the petitioner has however submitted that as the Life certificate had been submitted to the concerned Branch, which contains the information as required, the requirement of other formalities will cause great hardship to the petitioner, who is semi- paralyzed and presently residing in Nepal.

Mr. A. Dhar, learned counsel for the respondents Nos. 6, 7 8, submits that from the side of the Bank there is no impediment and on receipt of the fresh Pension Payment Order from the Assam Rifles respondents, the petitioner’s pension shall be released forthwith.

In view of the facts and circumstances of the case and not to cause hardship to the petitioner who is suffering, it is directed that the writ petitioner shall furnish a fresh copy of the Life certificate to the Assam Rifles respondents, within a period of 2(two) months, with a copy marked to the concerned Bank. On receipt thereof, the Assam Rifles respondents shall then process and issue the fresh Pension Payment Order of the petitioner, within a period of 3(three) months, thereafter.

With the above noted directions, this writ petition is accordingly disposed of.
