Judgment
This petition is filed for a writ of Certiorari calling for the records relating to the Show Cause Notice issued by respondent No.3, dated 28.04.2022, whereby the petitioner was asked to submit his explanation to the said notice as to why he should not be suspended from the post of ‘Sarpach’ and to appear in the Office of the District Collector, Medchal-Malkajgiri district on 07.05.2022, even though the matter is subjudiced and ceased by this Court in WP.No.17821 of 2022 by granting interim order on 11.04.2022 in IA.No.1/2022 suspending the removal order dt.14.02.2022; and for a consequential direction to the respondents to quash the show cause notice dt.28.04.2022 by declaring the same as illegal and arbitrary.
Heard learned counsel for petitioner and learned Standing Counsel for Panchayat Raj.
Learned Counsel for the petitioner submits that in the earlier writ petition No.17821 of 2022, the removal of the petitioner was questioned and accordingly, this court was pleased to suspend the removal order in IA.No.1/2022 on 11.04.2022; and that subsequent to the said order, the 3rd respondent has issued the impugned show cause notice seeking explanation from the petitioner as to why the petitioner should not be suspended. He further submits that since the matter is subjudiced by this court in WP.No.17821 of 2022, the respondents cannot come up with the present impugned notice seeking explanation for suspension.
In the aforesaid facts and circumstances, the petitioner shall give his explanation to the impugned show cause notice by 07.05.2022 and on such explanation, the 3rd respondent is directed to consider the said explanation and pass orders following due process of law taking into consideration the earlier order passed by this court in IA.No.1 of 2022 in WP.No.17821 of 2022, dt.11.4.2022. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
