Judgment

The present writ petition has been filed by the petitioner being aggrieved by the decision of the respondents declaring the petitioner’s bid as technically non-responsive in respect of contract for the operation of maintenance of 108 Emergency Response Services in Uttarakhand.
Learned counsel for the parties states that an identical grievance was dealt with by this Court vide its order dated 30.09.2026 in Writ Petition (M/B) No. 828 of 2026, and they submit that the present writ petition be also disposed of in the same terms.
The operative part of the order passed in the said writ petition is as follows:
“8.The writ petition is disposed of with liberty to the petitioner to file objection against the declaration of his bid as non-responsive and in respect to the declaration of the bid of respondent no. 4 as responsive, within two days and, on which, the respondents will pass a speaking order within next three days.
9.The acceptance of the bid of respondent no.4 shall be subject to the final outcome of the decision, which would be taken by the respondents on the representation of the petitioner.
10.In case, the petitioner does not make representation without 48 hours, the benefit of the instant order would not be available to the petitioner.”
Accordingly, the present writ petition is also disposed of in the same terms. It would be open to the petitioner to file supplementary representation within 24 hours along with the attested copy of the instant order so that the same is taken into consideration along with the pending representation.
Pending application(s), if any, also stand disposed of.
