The petitioner has approached this Court impugning Ext.P2 order issued by the first respondent transferring him from the “DV North LP
Schoolâ€, Kazhimbram to “SNA UP Schoolâ€, Padiyoor, Kannur.
I notice that this writ petition was filed as early as in the year 2014, with various allegations and averments; and that an interim order was granted
by this Court as early as in 26.09.2014, directing the maintenance of status quo as far as the petitioner is concerned. Pertinently, this order has
remained to be in force for the last more than seven years, when this writ petition has been pending and obviously therefore, I am of the view that the
petitioner cannot be now transferred based on Ext.P2, since the factual situation may have undergone a paradigm change during this period.
In the afore circumstances, without entering into the merits of any of the contentions of rival parties and leaving them all open to be pursued, if
required in future, I order this writ petition, confirming the interim order dated 26.09.2014; however, leaving liberty to the Authorities to take
appropriate action in future, if so required, after following due procedure in law.
