IA No. 3517/2023 - Adv. Yahya Batatawala appeared for the Applicant/Resolution Professional. The present application is filed by Mr. Arun Kapoor, Interim Resolution Professional under Section 12A r/w Regulation 30A(6) of the CIRP Regulations, 2016 seeking withdrawal of the C.P.(IB)381(MB)2022 in which admission order initiating CIRP against the Corporate Guarantor was ordered on 17.05.2023. The Committee of Creditors vide its first meeting dated 16.06.2023 decided to withdraw the present Company Petition. It is also been stated by the Counsel appearing for the Applicant that entire fees of the IRP stand paid.
In view of the averment made in this application and statement made by the Counsel appearing for the Applicant IA No. 3517/2023 is allowed and disposed of and C.P.(IB)381(MB)2022 filed under Section 7 is dismissed as withdrawn.
All the pending IAs/MAs if any, filed in the present petition shall also stand disposed of having become infructuous.
