Judgment
SOME goods were to be transported by M/s. Economic Transport Organisation, Transport Area, Chandigarh to Coimbatore by means of invoice dated 22.5.93. The goods valued at Rs. 8304.01p did not reach Coimbatore. A complaint was instituted on 1.5.95 and the District Forum ordered that a sum of Rs. 8304.01 together with a compensation of Rs. 1000/- and costs Rs. 300/- were payable by M/s. A.P. Agencies. By this judgment dated 9.8.95, the District Forum also decided connected complaint No. 498 which was dismissed as withdrawn.
TODAY at the out set it has transpired that the present appeal has been attempted against complaint No. 498 of 1994 which was dismissed as withdrawn and no appeal against complaint No. 356 of 1995 has been attempted. After hearing the learned Counsel for the parties it is clear that the present appeal has been attempted in a case where complaint was dismissed as withdrawn. This appeal is neither maintainable nor calls for interference and is hereby dismissed. Announced. The order be communicated to the parties free of charges. Appeal dismissed.
