Judgment
N.K. Patil, J.—Petitioners in these petitions have sought for a mandamus, directing the respondent No. 2 to approve the admissions of the petitioners 2-28 for the academic year 2013-2014 for B-Pharma Course and direct the second respondent to permit the petitioners 2-28 to appear for the forthcoming examination of B.Pharma.
I have heard Shri Shivarudra, learned counsel appearing for petitioners, Shri R. Omkumar, learned Additional Government Advocate appearing for State of Karnataka and Shri Ashok N. Nayak, learned counsel appearing for Rajiv Gandhi University of Health Sciences.
During the course of submission, learned counsel appearing for petitioners submitted that the subject matter involved in these petitions is directly covered by the order passed by the learned Single Judge dated 23rd April 2014 in Writ Petition Nos. 18613-18626/2014 (EDN.-RES) (Acharya and BM Reddy and others Vs. State of Karnataka and another) in identical matters. Therefore, he prayed that the instant writ petitions may also be disposed of in terms of the said order.
The said submission of the learned counsel appearing for petitioners is not disputed by the learned Additional Government Advocate appearing for State of Karnataka and learned counsel appearing for Rajiv Gandhi University of Health Sciences.
In light of the submission of the learned counsel appearing for the parties, the writ petitions filed by petitioners are allowed, following the order passed by the learned Single Judge dated 28th April 2014, in Writ Petition Nos. 186130 18626/2014 (EDN.-RES) (Acharya and BM Reddy and others Vs. State of Karnataka and another).
The Rajiv Gandhi University of Health Sciences is directed to permit the petitioners 2 to 28 to take up the ensuing examination, commencing from 13-05-2014, subject to fulfilling other eligibility criteria and subject to payment of penalty in a sum of Rs. 5,000/- (Rupees Five Thousand Only), per student, which shall exclusively be borne by the College.
Learned Additional Government Advocate is permitted to file memo of appearance on behalf of State of Karnataka and Shri. Ashok N. Nayak is permitted to file vakalath on behalf of Rajiv Gandhi University of Health Sciences, within four weeks from today.
