Judgment
Augustine George Masih, J.—Prayer in this petition is for issuance of a writ of mandamus to the respondents to depute the petitioners to the Lower School Course (List B-I) under 35% quota where their juniors have already been deputed.
It is the contention of the petitioners that the instructions, which have been made applicable to the claim of the petitioners for denying them the deputation for the course can only be prospective. In support of this contention, reliance has been placed upon a judgment of this Court in CWP No. 2914 of 2010 titled as EHC Virender Singh vs. State of Haryana and others, decided on 11.08.2010. Petitioners have served a legal notice dated 05.12.2011 (Annexure P-5) on the respondents but no decision thereon has been taken till date.
Counsel for the petitioners contends that the petitioners, at this stage, would be satisfied if a direction is issued to the Inspector General of Police, Railways, Haryana-respondent No. 3 to consider and decide the legal notice within some specified time.
Without going into the merits of the case or commenting thereon, the present petition is disposed of with directions to the Inspector General of Police, Railways, Haryana-respondent No. 3 to consider the legal notice dated 05.12.2011 (Annexure P-5) within a period of one month from the date of receipt of a certified copy of this order. The decision, so taken, be conveyed to the petitioners forthwith.
