Judgment
The petitioners/accused No.1 and two others are before the Court calling in question registration of a crime in Crime No.185 of 2026 registered for offences punishable under Sections 23, 24 and 59 of the Food Safety and Standards Act, 2006 (hereinafter referred to as ‘the Act’ for short) and Sections 316(2), 318(4) r/w 3(5) of the BNS.
Heard Sri B.S. Sachin, learned counsel appearing for the petitioners and Sri B.N. Jagadeesha, learned State Public Prosecutor-1 appearing for respondent No.1.
Facts, in brief, germane are as follows: -The company of the petitioners viz., M/s Earth Recycler Private Limited (‘the Company’ for short) is engaged in collection and disposal of expired food products, damaged consumer goods and other waste materials. It is the case of the complainant that the petitioners in the aforesaid engagement of business have collected expired food products, damaged consumer goods and other waste materials and indulged in re-labeling, re-packing and resale of those products to the general public. In the said fulcrum of the allegations, emerges a complaint from the public, which becomes a crime in Crime No.185 of 2026. Registration of the crime and ensuing investigation has led the petitioners to knock at the doors of this Court, calling in question the registration of the said crime and investigation taken thereon.
The learned counsel Sri B.S. Sachin, appearing for the petitioners would vehemently contend that the company of the petitioners is a private limited company, incorporated for the purpose of business of recycling, scientific segregation, processing and disposal of expired, damaged and discarded materials through environmentally compliant methods. The learned counsel would submit that the company of the petitioners never indulged in re-labeling, repackaging or sale of expired goods unfit for human consumption to the general public. The food safety authorities have visited the premises and upon inspection, issued certain notices with regard to storage arrangements and housing keeping measures. A preliminary enquiry under the Act is imperative. Without conducting any preliminary enquiry, without issuing any notice to the petitioners and without jurisdiction under the Act, a crime is mechanically registered against the petitioners and the Police have proceeded to seal the premises of the company causing hardship to the petitioners. The learned counsel submits that the Act is a complete Code on to itself, which provides a complete mechanism for inspection, collection of samples, analysis and prosecution. The jurisdictional Police cannot throw the procedure as obtaining under the Act to the winds by registering a crime under the BNS. He would place reliance on Sections 41, 42 and 47 of the Act to buttress his submissions on violation of the procedures since the offences are the ones punishable under Sections 23, 24 and 59 of the Act.
Per contra, Sri B.N. Jagadeesha, learned State Public Prosecutor – 1 appearing for the State, would stoutly refute the submissions advanced on behalf of the petitioners. He would contend that a mere peep into the original records would reveal circumstances which are not merely disturbing, but startling from the standpoint of food safety and public health. What is alleged against the petitioners is not an innocuous infraction of a regulatory prescription. The allegation is that expired products, which ought to have travelled towards recycling or destruction, were given a fresh lease of commercial life by re-labelling and were thereafter, pushed back into the market for sale to an unsuspecting public.
The learned State Public Prosecutor-I would draw attention to the articles allegedly recovered during the spot mahazar conducted on 22-04-2026. The inventory, he would submit, is itself telling. It includes milk, curd, fruits, vegetables, eggs, wheat flour, cool drinks, ready-mix products and, beyond food articles, washing powder and shampoo; and the catalogue, according to the prosecution, does not end there. What emerges from the mahazar, therefore, is alleged to be not an isolated aberration concerning a stray expired products, but an activity of a far wider sweep, which necessarily warrants investigation.
He would further submit that the investigation is yet to reach its logical terminus. Upon its completion, the material gathered would be placed before the competent authorities under the Act for such action as the law mandates. At this nascent stage, the jurisdictional Police cannot be expected to fold their hands and remain mute spectators merely because the allegations also traverse the territory occupied by a special enactment.
According to the learned State Public Prosecutor-1, when information reaches the Police that expired consumable products are allegedly being re-labelled and released once again into the stream of commerce, the Police cannot turn a blind eye and leave the health of the consuming public to chance. He would, therefore, submit that investigation into the allegations of this nature cannot be interdicted on the specious plea that the Act is a complete Code on to itself and, consequently, the jurisdictional Police are rendered powerless. The completeness of the special enactment, according to him, cannot be transformed into a charter of immunity against investigation into distinct offences alleged under the BNS.
The learned counsel for the petitioners would join issue in contending that the issue stands completely answered by the Apex Court in the case of SUSHIL KUMAR GUPTA v. STATE OF WEST BENGAL1 to contend that the Act is a complete Code by itself and the Police cannot interfere or alongside conduct any investigation into the matter.
I have given my anxious consideration to the submissions made by the respective learned counsel and have perused the material on record.
The afore-narrated business of the petitioners is not in dispute. The Company secures a licence on 05-07-2025, which is valid upto 04-07-2026, from the Government of Karnataka, Food Safety and Standards Authority of India. Form-C is as follows:

The aforesaid product of investigation is pursuant to registration of the crime. The issue now would be, whether the crime should be obliterated on the score that it runs counter to the procedure stipulated under the Act.
The offences alleged are the ones punishable under Sections 23, 24 and 59 of the Act. They read as follows:
“23.Packaging and labelling of foods.—(1) No person shall manufacture, distribute, sell or expose for sale or despatch or deliver to any agent or broker for the purpose of sale, any packaged food products which are not marked and labelled in the manner as may be specified by regulations:
Provided that the labels shall not contain any statement, claim, design or device which is false or misleading in any particular concerning the food products contained in the package or concerning the quantity or the nutritive value implying medicinal or therapeutic claims or in relation to the place of origin of the said food products.
(2)Every food business operator shall ensure that the labelling and presentation of food, including their shape, appearance or packaging, the packaging materials used, the manner in which they are arranged and the setting in which they are displayed, and the information which is made available about them through whatever medium, does not mislead consumers.
24.Restrictions of advertisement and prohibition as to unfair trade practices.—(1) No advertisement shall be made of any food which is misleading or deceiving or contravenes the provisions of this Act, the rules and regulations made thereunder.
(2)No person shall engage himself in any unfair trade practice for purpose of promoting the sale, supply, use and consumption of articles of food or adopt any unfair or deceptive practice including the practice of making any statement, whether orally or in writing or by visible representation which—
(a)falsely represents that the foods are of a particular standard, quality, quantity or grade-composition;
(b)makes a false or misleading representation concerning the need for, or the usefulness;
(c)gives to the public any guarantee of the efficacy that is not based on an adequate or scientific jurisdiction thereof:
Provided that where a defence is raised to the effect that such guarantee is based on adequate or scientific justification, the burden of proof of such defence shall lie on the person raising such defence.

59.Punishment for unsafe food.—Any person who, whether by himself or by any other person on his behalf, manufactures for sale or stores or sells or distributes or imports any article of food for human consumption which is unsafe, shall be punishable,—
(i)where such failure or contravention does not result in injury, with imprisonment for a term which may extend to three months and also with fine which may extend to three lakh rupees;
(ii)where such failure or contravention results in a non-grievous injury, with imprisonment for a term which may extend to one year and also with fine which may extend to three lakh rupees;
(iii)where such failure or contravention results in a grievous injury, with imprisonment for a term which may extend to six years and also with fine which may extend to five lakh rupees;
(iv)where such failure or contravention results in death, with imprisonment for a term which shall not be less than seven years but which may extend to imprisonment for life and also with fine which shall not be less than ten lakh rupees.”

Section 23 of the Act deals with packaging and labelling of foods. Every food business operator should ensure that the labelling and presentation are as is necessary in law. Section 24 of the Act deals with advertisement and prohibition of unfair trade practices. Section 59 of the Act punishes any person who manufactures, sells, stores or distributes unsafe food.
The contention of the petitioners is that, the procedure stipulated under Sections 41, 42 and 47 of the Act are given a go-bye. The provisions read as follows:
“41.Power of search, seizure, investigation, prosecution and procedure thereof.—(1) Notwithstanding anything contained in sub-section (2) of Section 31, the Food Safety Officer may search any place, seize any article of food or adulterant, if there is a reasonable doubt about them being involved in commission of any offence relating to food, and shall thereafter inform the Designated Officer of the actions taken by him in writing:
Provided that no search shall be deemed to be irregular by reason only of the fact that witnesses for the search are not inhabitants of the locality in which the place searched is situated.
(2)Save as in this Act otherwise expressly provided, provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 (46 of 2023) relating to search, seizure, summon, investigation and prosecution, shall apply, as far as may be, to all action taken by the Food Safety Officer under this Act.
42. Procedure for launching prosecution.—(1) The
Food Safety Officer shall be responsible for inspection of food business, drawing samples and sending them to Food Analyst for analysis.
(2)The Food Analyst after receiving the sample from the Food Safety Officer shall analyse the sample and send the analysis report mentioning method of sampling and analysis within fourteen days to Designated Officer with a copy to Commissioner of Food Safety.
(3)The Designated Officer after scrutiny of the report of Food Analyst shall decide as to whether the contravention is punishable with imprisonment or fine only and in the case of contravention punishable with imprisonment, he shall send his recommendations within fourteen days to the Commissioner of Food Safety for sanctioning prosecution.
(4)The Commissioner of Food Safety shall, if he so deems fit, decide, within the period prescribed by the Central Government, as per the gravity of offence, whether the matter be referred to,—
(a)a court of ordinary jurisdiction in case of offences punishable with imprisonment for a term up to three years; or
(b)a Special Court in case of offences punishable with imprisonment for a term exceeding three years where such Special Court is established and in case no Special Court is established, such cases shall be tried by a court of ordinary jurisdiction.
(5)The Commissioner of Food Safety shall communicate his decision to the Designated Officer and the concerned Food Safety Officer who shall launch prosecution before courts of ordinary jurisdiction or Special Court, as the case may be; and such communication shall also be sent to the purchaser if the sample was taken under Section 40.

47. Sampling and analysis.—(1) When a Food Safety
Officer takes a sample of food for analysis, he shall—
(a)give notice in writing of his intention to have it so analysed to the person from whom he has taken the sample and to the person, if any, whose name, address and other particulars have been disclosed;
(b)except in special cases as may be provided by rules made under this Act, divide the sample into four parts and mark and seal or fasten up each part in such a manner as its nature permits and take the signature or thumb impression of the person from whom the sample has been taken in such place and in such manner as may be prescribed by the Central Government:
Provided that where such person refuses to sign or put his thumb impression, the Food Safety Officer shall call upon one or more witnesses and take his signature or thumb impression, in lieu of the signature or thumb impression of such person;
(c)(i) send one of the parts for analysis to the Food Analyst under intimation to the Designated Officer;
(ii)send two parts to the Designated Officer for keeping these in safe custody; and
(iii)send the remaining part for analysis to an accredited laboratory, if so requested by the food business operator, under intimation to the Designated Officer:
Provided that if the test received under sub-clauses (i) and (iii) are found to be at variance, then the Designated Officer shall send one part of the sample kept in his custody, to referral laboratory for analysis, whose decision thereon shall be final.
(2)When a sample of any article of food or adulterant is taken, the Food Safety Officer shall, by the immediate succeeding working day, send the sample to the Food Analyst for the area concerned for analysis and report.
(3)Where the part of the sample sent to the Food Analyst is lost or damaged, the Designated Officer shall, on a requisition made to him, by the Food Analyst or the Food Safety Officer, despatch one of the parts of the sample sent to him, to the Food Analyst for analysis.
(4)An article of food or adulterant seized, unless destroyed, shall be produced before the Designated Officer as soon as possible and in any case not later than seven days after the receipt of the report of the Food Analyst:
Provided that if an application is made to the Designated Officer in this behalf by the person from whom any article of food has been seized, the Designated Officer shall by order in writing direct the Food Safety Officer to produce such article before him within such time as may be specified in the order.
(5)In case of imported articles of food, the authorised officer of the Food Authority shall take its sample and send to the Food Analyst of notified laboratory for analysis who shall send the report within a period of five days to the authorised officer.
(6)The Designated Officer, the Food Safety Officer, the authorised officer and the Food Analyst shall follow such procedure as may be specified by regulations.”

Section 41 of the Act delineates the power of search, seizure, investigation and prosecution. It empowers the Food Safety Officer, upon entertaining a reasonable doubt on a person, that any article of food or adulterant is involved in the commission of an offence under the Act, to search the premises and seize such article. Sections 42 and 47 of the Act thereafter, prescribe the statutory pathway for launching prosecution and the procedure for sampling and analysis.
If the allegations against the petitioners were confined, simpliciter, to contraventions punishable under Sections 23, 24 and 59 of the Act, the submission of the learned counsel for the petitioners that the statutory procedure must hold the field may have merited consideration on an altogether different footing. But, that is not the canvas on which the present crime is painted.
The allegations travel beyond the precincts of the Act. They are an amalgam of offences under the Act and the offences punishable under Sections 316 and 318 of the BNS. The latter allegations cannot be brushed away, merely because the articles around which the crime revolves happen to be food products.
When information disclosing such acts reaches the jurisdictional Police, the Police cannot fold their hands, turn a Nelson's eye to the allegations and proclaim helplessness merely because a special enactment occupies the field. No doubt, the Act is a complete Code in respect of matters entrusted to the authorities constituted thereunder. But the completeness of the special enactment cannot become a cloak of immunity against investigation into distinct offences alleged under the general penal law. The two must operate in their respective spheres and, where the allegations overlap, in statutory harmony rather than mutual exclusion.
The stage presently reached is one of investigation and not prosecution. Therefore, the jurisdictional Police, while proceeding with the investigation, shall necessarily associate the competent Officers of the Food Safety Department, wherever the provisions of the Act demand their involvement. When the investigation fructifies into prosecution, the papers shall be placed and the prosecution be launched strictly in consonance with the statutory architecture noticed hereinabove. Thus understood, investigation by the Police and compliance with the mandate of the special enactment are not competing streams; they can, and in a case of this nature must, flow together until the law requires them to take their respective courses.
There is yet another feature, which cannot be lost sight of. The controversy is not merely about the quality of food ordinarily stocked for sale. The very business professed by the petitioners is the procurement of expired food products and other discarded articles for the avowed purpose of recycling / selling them. The allegation, however, is far more sinister. It is alleged that articles procured precisely because they have crossed their shelf-life and are destined for recycling are being diverted from that legitimate stream, re-labelled, re-packed and pushed back into the stream of commerce for sale to unsuspecting members of the public at alluringly lower prices. If the allegation is ultimately proved, what was destined for destruction or recycling is given a deceptive reincarnation as a marketable commodity, the consumer sees a bargain; what is concealed from him is the peril behind the bargain.
Such an allegation cannot be viewed through the narrow prism of a mere regulatory infraction. It strikes at the very heart of consumer confidence and, more importantly, at public health. Food is not an ordinary article of commerce. What reaches the market ultimately reaches the human body. A deceptive label upon an expired food product, therefore, is not merely ink upon a package; it is, if the allegation be true, a deception capable of carrying consequences to the health and safety of an unsuspecting citizen.
It is in this backdrop, that the allegation of cheating assumes significance. The traditional imagery of cheating often conjures up two identifiable individuals—the deceiver and the deceived—the former inducing the latter, with dishonest intention from inception, to part with property. Crime, however, has never remained frozen in time. Its methods mutate; its manifestations change; its reach expands with commerce, technology and ingenuity. If crime is dynamic, interpretation of the criminal law cannot afford to remain static, provided, of course, the interpretation remains anchored to the ingredients of the offence enacted by the Legislature.
A conventional one-to-one transaction may readily fit within the classical mould of deception. But deception need not always knock upon the door of a predetermined victim. An article allegedly re-labelled and released into the open market, carries the representation to every potential consumer who encounters it. The victim may not be known to the alleged deceiver by name; he may nevertheless be the very person whom the deception is designed to induce. The anonymity of the consumer cannot, by itself, confer anonymity upon the alleged crime.
The allegation in the case at hand is precisely of this character. Expired products, admittedly procured for recycling, are alleged to have been re-labelled and reintroduced into the market for sale to the general public. The allegation, therefore, is not merely that an expired article lay forgotten on the shelf of a shop. It is one of an alleged deliberate transformation of the identity of the product—of making the expired appears unexpired and the un-saleable appears saleable—with the ultimate consumer being none the wiser. At the stage of investigation, such allegations cannot be brushed aside as incapable of attracting the offence of cheating.
This Court cannot permit procedural technicalities / infirmity to become a sanctuary for allegations that directly implicate public health. Procedure is undoubtedly the handmaid of justice and statutory safeguards must be scrupulously observed; but neither can be converted into a shield to prevent investigation into allegations of conduct potentially hazardous to an indeterminate number of consumers. To obliterate the crime at its threshold, on the facts presently available on record, would be to terminate the investigation precisely when the allegations demand that the truth be unearthed. Public health cannot be made to stand in the queue behind technical objections.
The consequences of interdiction at this stage could be grave. If the crime were to be quashed solely on the asserted procedural infirmities and the allegations were thereafter ,found to possess substance, the result would not merely concern the petitioners or the complainant; it could expose an unsuspecting consuming public to products, which had crossed their permissible life and were allegedly dressed up with new labels to masquerade as fit for commerce. A constitutional Court cannot be oblivious to such a possibility while exercising its extraordinary jurisdiction to annihilate a criminal proceeding at its inception.
Equally disquieting is the apparent incongruity between the notice issued by the Food Safety Authorities concerning improvement and upkeep of the premises and what the Police claim to have unearthed under the spot mahazar and placed before the Court in the property form. If the latter material is what the prosecution claims it to be, a notice confined merely to housekeeping or upkeep, cannot be permitted to draw a curtain over allegations of a far more serious nature. The apparent discord itself is a circumstance, which warrants investigation rather than its premature burial.
The distinction urged by the petitioners on sampling also becomes evident. Had the petitioners been ordinary retailers or distributors storing food products which, during the course of storage, were alleged to have become unsafe or expired, the contention that samples ought to have been drawn and the procedure involving the Food Safety Officer strictly followed may have stood on a different pedestal. That is not the allegation here.
The petitioners' professed business itself involves procurement of products, which have already expired, for the purpose of recycling and disposal. The factum of expiry of those products is, therefore, not the mystery that sampling is required to unravel. The gravamen of the accusation lies elsewhere: that products procured because they had expired and were meant to travel towards recycling were allegedly diverted, re-labelled and sent travelling in the opposite direction—back to the market and ultimately to the consumer. Sampling cannot become the answer to a question which is not being asked.
The question under investigation is, not whether an admittedly expired product has expired. The question is, whether such expired products, procured for recycling, were deliberately re-labelled and resold to the unsuspecting public as though they were fit for ordinary commerce. That allegation requires investigation. The investigation shall, however, proceed with the involvement of the competent authorities under the Act wherever statutorily required, and any prosecution ultimately launched shall conform scrupulously to the procedure prescribed by law.
The re-labelling of expired food products and their re-entry into the stream of commerce is not a mere infraction of food-safety regulation; it is a calculated assault on public health. An expiry date is not an ornamental inscription on a package, capable of being erased and replaced at the whim of a trader. It marks the outer boundary beyond which the safety and quality of the product for human use can no longer be assured. Once that boundary is crossed, deterioration, microbial contamination, chemical alteration and loss of nutritional integrity may set in, sometimes silently and without any visible warning. Milk and curd may harbour harmful bacteria; eggs and other perishables may become breeding grounds for pathogens; flour, ready-mixes and packaged foods may develop moulds or toxins; beverages may undergo chemical degradation; and even products such as shampoos and other articles of personal use may lose stability and cause adverse reactions.
To erase an expiry date, affix a fresh label and place such a product back on the shelf is, therefore, to dress decay in the garb of freshness and deception in the attire of trade. The unsuspecting consumer purchases it believing it to be safe, while what is actually sold is an undisclosed and potentially grave risk to health. The peril assumes greater proportions when such products reach children, pregnant women, the elderly or persons with diminished immunity, for whom an episode of food poisoning may have consequences far beyond temporary discomfort. Profit can never be permitted to flourish upon the ruins of public health.
The mushrooming instances of hotels and eateries stocking, preparing and supplying expired food cannot be brushed aside as stray infractions of regulatory prescriptions. They reveal a disturbing malaise creeping into the hospitality industry, where the hunger for profit appears, in some cases, to have overtaken the elementary obligation to protect the health of the consumer. A customer who walks into a hotel and pays for a meal does so with an implicit faith that what reaches his plate is wholesome, hygienic and fit for human consumption. He cannot be expected to enter the kitchen, inspect the refrigerator, scrutinise every packet for its expiry date or investigate the provenance of every ingredient before taking a morsel. That trust is the very foundation upon which the food industry rests.
When expired milk, curd, flour, meat, vegetables, sauces or other ingredients find their way into the kitchen and ultimately onto the plate of an unsuspecting consumer, the wrong travels far beyond a mere breach of licence conditions. It is a sin; the food, which sustains life, is imperilled by the act of such sinner. Recent enforcement actions have disclosed alleged rackets employing precisely such methods to push expired products back into the stream of commerce. Such conduct, if established, is not merely neglect; it is deception dressed as commerce.
The increasing recurrence of such discoveries must therefore awaken the regulatory machinery. Surprise inspections cannot remain occasional exercises undertaken only after public outrage erupts. Food safety requires constant vigilance, rigorous traceability of expired stock, prompt destruction of articles unfit for consumption and consequences sufficiently stringent to ensure that treating the consumer’s health as expendable never becomes a profitable business model.
The kitchen of a hotel may remain beyond the customer’s sight, but it can never remain beyond the reach of the law.
For the aforesaid reasons, the petition is bereft of merit and is accordingly rejected.
The interim order, if any, operating in the petition shall stand dissolved.
