Judgment

Having heard the matter at some length, it appears that though the entitlement of the petitioner indeed deserves consideration as prayed, the issue as to whether he falls under the Old Pension Scheme as per his contention and also going by the communication that has been sent by the B.B. Kishan College Jalah, on the queries by the respondent NEHU, it appears that this matter can be settled by a simple clarification from the respondent No. 7 (The State of Assam, represented by the Commissioner & Secretary in the Education (Higher) Department), who though had appeared on the earlier occasions is not present today and also failed to file any affidavit.
In this view of the matter, this Court has taken note of the non-appearance by the respondent No. 7 and the fact that no assistance has been rendered to this Court to resolve the matter. Accordingly, it is directed that the respondent No. 7 be represented on the next date with sufficient instructions on the matter.
The Registry is directed to send a copy of this order on top priority to the respondent No. 7 for appearance, and the failure to appear on the next date, will warrant further action from this Court.
The parties also to obtain any information, which are relevant to the instant matter, and to apprise this Court on the next date.
