Judgment
Vineet Kothari, J.—By the impugned order dt. 01.02.2011 passed by the learned Dist. Judge, Sri Ganganagar in Civil Misc. Case No. 55/2009, the learned trial Court has rejected the application under Order 39 Rule 1 and 2 C.P.C. The plaintiffs are in appeal before this Court. By the interim order dt 01.02.2011, this Court has directed that the respondents shall not withdraw the amount lying deposited in MI Scheme with the respondent-Post office.
The proceedings under Sec. 372 of the Indian Succession Act between the parties are still pending before the learned Dist. Judge, Sri Ganganagar.
In the circumstances of the case, it is considered expedient to dispose of this appeal by requesting the learned Dist. Judge, Sri Ganganagar to expedite the hearing of the said proceedings under Sec. 372 and preferably conclude the same within a period of one year from today and till then the itnerim order granted by this Court shall continue. With the aforesaid observations, the present appeal is diposed of. No order as to costs.
