DVC Pensioner's Forum Chandra Unit (having registration no.2716) through its Joint Secretary vs Damodar Valley Corporation through its Chairman

Instant writ petition has been filed by DVC Pensioner’s Forum Chandra Unit (having registration no.2716 for the following reliefs on behalf of DVC employees, who had retired from service and were permitted to retain the Quarters as licensee : -

i. For issuance of an appropriate writ, order or direction for quashing/setting aside the letter bearing no. 908 dated 04.06.2024 (Annexure 6) issued under the signature of Executive Director (HR), Damodar Valley Corporation (in short ‘DVC'), whereby and whereunder the management of DVC, based on three letters have passed an order that various projects of DVC shall pass respective orders for retention of quarters.

ii. For quashing Clause 2 (o) of letter no. Director (E, L & R) / Quarter-Lease/Ex- employees/765 dated 13.02.2023 (Annexure 2) whereby and whereunder the management has been pleased to enhance the damage charges to four times the normal rent of such accommodation along with interest @12% per annum (to be compounded monthly).

iii. For Quashing Clause 4 of the O.M. No. 935 dated 18.08.2023 (Annexure- 4) whereby and whereunder it has been directed that the licensee shall be liable to pay damages at the following rates:

a. First six months- 15 times of the normal license fee.

b. Next six months- 20 times of the normal license fee.

c. After one year 25 times of the normal license fee

iv. The petitioner further prays for issuance of an appropriate writ, order or direction upon the respondents to allow the petitioner to retain the quarters allotted to them.

v. For quashing the office memorandum no. 126 dated) 03.02.2025 (Annexure-7), whereby and whereunder a decision has been taken to ascertain the damage @ Forty (40) times of licensee fee in regard with retention of Quarters beyond the authorized retention period.

Heard the counsel on behalf of the Petitioner and Respondents.

From perusal of the pleadings of the writ petition, it is apparent that no specific pleadings have been made with regard to what was earlier license fees and what is quantum by which the present license fees has been enhanced. It has also not been stated that who have suffered on account of the said enhancement. Neither the details of Quarter Number nor previous and present actual license fees have been stated. In the absence of necessary particulars, it is difficult to make out what legal rights has been violated and of whom.

On these sketchy pleadings, this Court is of the view that writ petition is not maintainable, which is accordingly, dismissed with cost. Interlocutory Application, if any, is disposed of.
