This matter is taken up by video conferencing mode. Mr. Karunakar Nayak, learned counsel appearing for the State seeks some timeÂ

to obtain instruction in the matter.

Mr. A.R. Panda, learned counsel for the petitioner relied on a decision of this Court in case of Kishore Kumar Choudhury -Vrs.- State of Odisha

reported in (2017) 66 Orissa Criminal Report 1124 wherein this Court held that the question of confiscation would rise only after completion of trial. It

is contended by the learned counsel for the petitioner that the ground on which the petition filed by the petitioner under section 457 of Cr.P.C. for

release of the vehicle of the petitioner has been rejected by the learned Special Judge, Phulbani in Criminal Misc. Case No.14 of 2020 vide order

dated 23.11.2020 is quite illegal and not sustainable in the eye of law.

Issue notice on the question of admission indicating therein that the matter shall be disposed of at the stage of admission.
