Judgment

Heard.
The Petitioner is facing prosecution in connection with C.T. Case No.96 of 2019 arising out of Baipariguda P.S. Case No. 68 of 2019 corresponding to G.R. Case No. 449 of 2019 U/s. 376(2)(n)/384/506/34 of IPC read with Section 67(a) of IT Act pending in the Court of learned Ad-hoc Addl. Sessions Judge (FTSC), Jeypore, District-Koraput.
The petitioner was granted bail on 07.11.2019. However, the Petitioner did not appear before the Court below on 07.02.2024 leading to issuance of NBW(A) against him.
Learned counsel for the Petitioner on instruction from his client undertakes that his client would be appearing before the Court below on or before 15th March, 2024 and seeks appropriate remedy available to him under law.
Taking into consideration the above facts and submission at the Bar, the order dated 07.02.2024 passed by the learned Ad-hoc Addl. Sessions Judge (FTSC), Jeypore, District-Koraput in connection with C.T. Case No.96 of 2019 arising out of Baipariguda P.S. Case No. 68 of 2019 corresponding to G.R. Case No. 449 of 2019 is set aside, subject to the Petitioner paying cost of
Rs.500/-(Rupees Five Hundred) to be deposited in the Orissa High
Court Advocates’ Welfare Fund.
The CRLMC is disposed of.
