Judgment
This original application was registered on a letter petition dated 06.06.2022 received from residents of Village Darbaripur and Hasanpur, Gurugram, Haryana.
The complaint is that there are industrial establishments like Suzuki Company, Mahindra & Mahindra and Sudhar Metals and Alloy at Darbaripur, Hasanpur road, Khekri Daula Road, Sector-75, Gurugram who are emitting polluted air affecting health of local residents and they are not complying with environmental norms in respect of emission of polluted air.
Considering the complaint made, this Tribunal sought a factual report constituting a joint Committee comprising State PCB and District Magistrate, Gurugram vide order dated 02.01.2023. Pursuant thereto, joint Committee has submitted report dated 17.02.2023 wherein detailed findings in respect of each and every Proponent has been given and it is shown that all the Proponents are compliant with the various provisions of environmental laws and requisite clearance/consent etc. have also been obtained by the said Proponents.

The unit is engaged in manufacturing of two wheelers. The unit has power press sheet metal operations- welding, paint shop, injection molding and assembly operations. The unit has installed 03 nos. of PNG fired boilers & 03 nos. gas generators and 04 nos. of DG Sets of 1500 KVA X 3 nos. & 500 KVA X 1 no. DG sets are not in operation as unit has installed Gas generators).
Further, it is submitted that the unit is using Cleaner fuel i.e. PNG in its 03 nos of boilers & generators.
The unit has also installed online monitoring device on the stack attached to the Boilers.
The unit is having valid Consent to Operate under Water and Air Act from HSPCB (valid till 30-09-2025). The unit is complying under Water and Air Act and no
further action is required. Copy of CTO and photographs attached as Annexure-R1.

Sudhar Metals and Alloys, Darbaripur- Hasanpur Road, Village- Kherki Daula, NH-8, Delhi Jaipur Highway, Gurugram
The unit is engaged in manufacture of aluminium ingots by melting into the furnace. The unit has 01 no. stack attached to furnace section and has provided Wet Scrubber as Air Pollution Control Device. The unit is using cleaner fuel i.e. PNG in the Furnace. The unit has also installed 02 nos of DG sets and having proper stack height and acoustic enclosure. The unit is having valid consent to operate under Water and Air Act from the HSPCB (valid till 31-03- 2027).
The unit is complying the Water and Air Act and no further action is required. Copy of CTO and photographs attached as Annexure-R2.

M and M Machine craft Pvt. Ltd., Darbaripur- Hasanpur Road, Village- KherkiDaula, NH-8, Delhi Jaipur Highway, Gurugram
The unit is engaged in manufacture of auto components and has installed CN machines for the same. The unit does not have air emission from the unit except DG sets.
DG sets installed by the unit have proper stack height and acoustic enclosure.
The unit is having valid Consent to Operate under Water and Air act from the HSPCB (valid till 31-12-2027). The unit is complying the Water and Air Act and no further action is required. Copy of CTO and photographs attached as Annexure- R3.
We do not find any reason not to accept the said report. The report is accepted.
Since, nothing adverse has been found on the part of the said Proponents in respect of compliance of the provisions of environmental laws and norms, hence, no further order needs to be passed in this matter.
The application is accordingly disposed of.
