Ramesam, J.—Apart from some differences in minor details in the cases I think the principle of AIR 1927 206 (Privy Council) and of the decision of Phillips and Curgenven, JJ., in Appeal No. 416 of 1923, governs this case. The decision of the Courts below is right.
